General Terms and Conditions
1. Registration
By registering, making a reservation or ordering a voucher, you accept these general terms and conditions as part of the contract between you and Chickenwings.
2. Payment terms
Ordered vouchers are delivered to the buyer promptly after receipt of payment. For registrations or reservations without a valid voucher, the participant must pay the price in cash at the start of the trip.
3. Withdrawal by the customer
If the participant cancels the activity or leaves it early, it is deemed to have ended and been fulfilled.
Failure to appear on the agreed flight day counts as withdrawal by the customer, whereby the voucher expires. If the flight cannot be carried out fully, or only in shortened form, due to a delay caused by the customer, the voucher likewise expires.
In the event of a cancellation or postponement 24 hours or less before the appointment, the flight expires and the amount cannot be reclaimed.
Registrations are binding. To protect yourself in the event of illness, accident, etc., I recommend taking out travel cancellation / cancellation cost insurance. Taking out this insurance is the customer's responsibility.
4. Withdrawal by the organiser
Chickenwings may cancel the activity if participants give justified cause to do so through their actions or omissions. This corresponds to expiry of the voucher.
Should weather and natural conditions, force majeure, official measures, safety or other similar reasons significantly impede, endanger or render the activity impossible, Chickenwings may cancel or abort the activity at any time. In this case vouchers are automatically extended by 1 year, and amounts paid in cash are refunded.
5. Flight time
The duration of the flight depends, among other things, on the weather conditions. If the defined flight time of an offer is not reached, the passenger is refunded the price difference to a starter flight in the form of a voucher.
If the paragliding flight is aborted by the passenger before the minimum flight duration is reached, the flight is deemed to have been flown and no refund is due.
6. Duties to cooperate and conditions of participation
Good health is a prerequisite for paragliding flights. The participant undertakes to inform Chickenwings in advance of any health problems.
Minors require the consent of a legal guardian. If no legal guardian is present on site, the consent must be provided in written form.
The participant undertakes to meet the conditions of participation and to strictly follow the instructions of Chickenwings. If the conditions of participation are not met or instructions are not followed, Chickenwings may exclude the participant from the activity. In the event of exclusion, no refund of amounts paid is made and vouchers expire.
7. Photo and video recordings
During the trip – before, during and after the flight – photos and videos are taken in which you may appear. By taking part, you consent to Chickenwings using these recordings free of charge for its own advertising purposes, in particular on the website, on social media channels (e.g. Instagram, Facebook) and in other promotional material.
This consent is voluntary. If you do not want recordings of you to be published, an informal notice (verbally or by message) before the flight is sufficient – in that case Chickenwings refrains from publishing them. Consent can be withdrawn at any time with effect for the future; publications that have already lawfully taken place remain unaffected.
8. Insurance
Paragliding is not a high-risk sport and is covered by standard accident insurance (UVG). Passengers from other countries (place of residence being decisive) must have appropriate insurance. Participants are not insured by the organiser.
9. Liability
9.1 Exclusions of liability
Chickenwings is not liable for damages arising from the actions of third parties, participants, force majeure, natural events, official measures or the like.
If Chickenwings transfers performance to a partner or another third party, it is not liable for their actions and omissions. In particular, Chickenwings is not liable for damages attributable to actions or omissions of the partner or third party that are not connected with the contractually agreed service.
If a participant does not follow the instructions of Chickenwings, all liability is excluded.
9.2 Special liability provisions
The offers are deemed to be a non-high-risk sport. Non-occupational accident insurance (e.g. SUVA) and health insurance must be in place and are the participant's responsibility; they must be presented on request on site. Cancellation cost insurance is recommended and is the participant's responsibility.
Carriage on paragliding flights is not subject to the liability provisions of the Ordinance on Air Transport of 17 August 2005. The liability of the pilot or contractual partner towards the passenger is contractually limited, upon issue of a flight ticket, to CHF 5,000,000.– for death or bodily injury and CHF 2,000.– for loss of or damage to items carried.
9.3 Non-contractual liability
Non-contractual liability is governed by the relevant statutory provisions. Insofar as these general terms and conditions provide for stricter liability requirements, liability limitations or liability exclusions, these shall apply.
10. Legal information about the website
All information, documents or other details on the Chickenwings website are subject to the following provisions. Please read them carefully. By using and/or retrieving information and documents from the Chickenwings website, you expressly agree to the following conditions:
10.1 No offer / exclusion of warranty
The purpose of the website is to provide information about my services. It does not constitute an offer in the legal sense. The website has been prepared to the best of my knowledge, but no guarantee is given that the information, documents or other details provided are error-free and complete.
10.2 Limitations of liability
Chickenwings is in no case liable for any direct or indirect damages and consequential damages arising from the use of information and material from the website or from access via links to other websites. I give no warranty that information, documents or other details accessible via the website are free from viruses or other harmful components.
10.3 Links to other websites
It is possible to reach other internet sites via links on this website that are not maintained by Chickenwings. Such external internet addresses contain information created, published, maintained or otherwise made available by organisations and natural or legal persons that are independent of Chickenwings. Chickenwings is neither responsible for the content of these pages, nor do I endorse, support or confirm information contained on external pages or in the linked addresses listed therein.
